Terms & Conditions

How Vesak Care Foundation operates its website, VesakCare app, WhatsApp / Meta channels, home care for patients and families, gig care workers, employees, volunteers, health camps, and community outreach — in line with compassion, integrity, and accountability.

1. Acceptance of these Terms

By using Vesak Care Foundation services — including this website (www.vesakcare.com), the VesakCare operations / staff app and portals, WhatsApp Business messaging, Meta (Facebook / Instagram / WhatsApp) experiences we operate, donation forms, volunteer applications, health-camp registrations, and related digital tools — you agree to these Terms & Conditions and our Privacy Policy.

If you do not agree, please do not use these services. If you use VesakCare on behalf of a family member, organisation, or patient, you confirm you are authorised to do so.

2. Who we are

Vesak Care Foundation (“VesakCare”, “we”, “us”) is a Section 8 not-for-profit company (CIN U88900MH2025NPL460992), incorporated in India, with registered address at Kolhapur, Maharashtra, and operations linked to Kolhapur, Pune, and Mumbai.

We exist to deliver compassionate, professional home healthcare and community health outreach — so that seriously ill and vulnerable people receive dignity, reliability, and care they can trust.

3. Our business ethics (what we stand for)

These Terms are read together with our operating values:

  • Compassion — treat every patient and family with the respect we would want for our own.
  • Integrity & transparency — honest communication about services, fees (where applicable), donations, and limitations; no selling of personal data.
  • Excellence & accountability — trained professionals, clear roles, and escalation when something goes wrong.
  • Dignity of work — fair engagement of nurses, caretakers, physiotherapists, attendants, employees, and volunteers; no exploitative practices.
  • Community responsibility — health camps and environment-linked outreach aim to build capacity and safe community health, not one-day spectacle.

4. What these Terms cover

These Terms apply to interaction with VesakCare in connection with:

  • Patients & families — home nursing, attendant / caretaker support, physiotherapy and rehab, chronic and elderly care, maternal / newborn support, and family care navigation.
  • Gig / field care workers — nurses, caretakers, physiotherapists, attendants, and similar professionals engaged for shifts or cases (onboarding, scheduling, attendance, conduct, and payouts as applicable).
  • Employees & office staff — salaried or contracted roles supporting care delivery and operations.
  • Volunteers — medical volunteers, companion caregivers, community mobilisers, technology / admin volunteers, and camp support.
  • Health camps & community outreach — registration, screening, awareness, referrals, and local coordination.
  • Environment & community health linkage — field activity connected to camp logistics and community health (venue readiness, sanitation awareness, outreach coordination), where we collect only operationally needed information.
  • Donors & CSR partners — donations, receipts, and stewardship communication.
  • Digital channels — website, VesakCare app / portals, WhatsApp chatbot and OTPs, Meta ads / lead forms, email, and phone.

5. Patients, families & home care

Website and WhatsApp information helps you enquire about care. A care arrangement starts only after our team confirms availability, scope of duties, and applicable terms for that case.

  • Families must provide accurate medical and contact information needed for safe assignment.
  • VesakCare coordinates care; individual clinicians and care workers provide services within their training and assigned scope.
  • Our services are not a substitute for emergency medical care. In an emergency, call local emergency services immediately.
  • We may decline or pause an assignment where safety, legality, or professional standards cannot be met.

6. Gig care workers (nurses, caretakers, physiotherapists, attendants)

Gig / field professionals may be engaged for shifts or cases. Engagement is subject to separate onboarding, identity / compliance checks (as required by law), role definitions, scheduling rules, and payment terms communicated in the VesakCare systems or agreements.

  • Public website content does not by itself create employment; the nature of engagement (employee vs contractor / gig) is defined in the applicable documents and law.
  • Care workers must follow patient dignity, confidentiality, punctuality, and conduct standards; serious breaches may lead to suspension or removal from assignments.
  • Attendance, messaging (including WhatsApp punch / OTP flows where enabled), and payout records in the VesakCare app are operational records used for coordination and compliance.

7. Employees & office staff

Employees and office staff are governed by appointment letters, HR policies, role permissions in the VesakCare app, and applicable labour law. Access to patient, donor, or workforce data is role-based. Misuse of systems, data, or brand may result in disciplinary action and legal remedies.

8. Volunteers

Volunteering (medical, companion care, community mobilisation, tech / admin, camp support) is subject to application screening, training where required, and role-specific guidelines.

  • Volunteering does not automatically create employment or a right to payment.
  • Volunteers must protect patient and participant privacy and follow camp / field safety instructions.
  • VesakCare may end a volunteer engagement if conduct or safety standards are not met.

9. Health camps, outreach & environment-linked work

Health camps and community programmes may include registration, screening, awareness, and referral pathways. Environment-linked activity (for example sanitation awareness or camp-site readiness) supports community health logistics — it is not a guarantee of clinical outcomes.

  • Participation may require consent and accurate registration details.
  • Camp services are typically screening / awareness oriented; follow-up care may need separate arrangements with facilities or VesakCare home-care pathways.
  • We may cancel or modify events for weather, safety, permissions, or operational reasons.

10. VesakCare app, WhatsApp & Meta channels

The VesakCare app / portals support operations (cases, scheduling, documents, messaging, compliance). WhatsApp may be used for enquiries, owner / staff alerts, OTP login, punch flows, and automated assistance where enabled.

  • Keep login credentials and OTP codes confidential.
  • Do not use messaging channels to harass staff, share unlawful content, or request actions outside professional scope.
  • Meta Platforms may process delivery metadata under Meta’s terms when you use WhatsApp / Facebook / Instagram features connected to VesakCare.
  • We may suspend digital access to protect patients, staff, or system integrity.

11. Donations & CSR

Donations support Vesak Care Foundation’s charitable objects. Tax benefits (such as 80G) depend on applicable law and the status of our registrations at the time of giving. Receipts and donor data are handled under our Privacy Policy. Misuse of donation channels or false claims may be reported to authorities.

12. Accurate information

You agree to provide accurate details in enquiries, applications, camp registrations, donor forms, and workforce onboarding. Knowingly false information that risks patient safety or compliance may lead to refusal of service and legal action.

13. Intellectual property

Website content, logos, creatives, playbooks, and materials belonging to Vesak Care Foundation may not be copied or reused commercially without prior written permission, except as allowed by law. Patient stories and images are used only with appropriate consent.

14. Limitation of liability

To the fullest extent permitted by Indian law, Vesak Care Foundation is not liable for indirect or consequential losses arising from use of the website, app, or messaging channels. Nothing in these Terms excludes liability that cannot legally be excluded (including for fraud or wilful misconduct). Clinical outcomes depend on many factors beyond coordination alone.

15. Privacy & data deletion

Personal data is processed under our Privacy Policy. To request access, correction, or deletion, use Contact or the channels listed in the Privacy Policy. We will respond subject to legal retention duties (tax, audit, care accountability, workforce records).

16. Governing law

These Terms are governed by the laws of India. Courts at Kolhapur, Maharashtra (or as required by mandatory law) shall have subject-matter jurisdiction, without prejudice to any non-waivable consumer or labour protections.

17. Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use after an update means you accept the revised Terms.
